October 12, 2007 My Mom Can not Even Afford her Medication Anymore

Mr. Paisola

Hello,

My name is Jay Wortham.  My mom had a similar situation to one the clients listed on your survey of information.  My mother is 67 yeras old and takes several different kinds of expensive meication.  A creditor has placed a bank levy on her account and my own account since I had her name on it.  My mom can't even afford vital medication and food now because of these levy.  Please hep. October 12, 2007 More Complaints on Unifund

My name is Jamii Stone and I am writing on behalf of my husband Mark Barackman. I recently checked Mark's credit report and found that UNIFUND bought his credit card debt that was last active 2001 yet Unifund states that the last activity on the account is Sep. 2005 yet the account says it was "written off" by the originator Providian Bank in 2001. Is this legal for Unifund to do this? I have not yet contacted Unifund or Providian and they have not contacted either of us. I am afraid and I don't know what to do. How do I get Unifund off my husbands credit report without having to pay exorbitant fees? I visited Unifunds website and did not find a phone number.

Anyone who can help please email me regarding this matter, savethebees@gmail.com Thank You, Jamii Stone Barstow, CA

October 11, 2007 Unifund Class Action request AGAIN!

How do we become part of a class action suit against Unifund?  We live in Arizona and received a summons that we were being sued by Unifund for an account that we never had and that is not on our credit report.  We answered the summons denying the claim and demanded proof of a contract that showed they had the authority to sue us.  How long do they have to respond and give us any documentation showing we owe them?
If we are allowed we want to be part of any action that stops a company like Unifund.  They file their cases in small town justice courts hoping that they will get a default judgement.  I researched the over 3000 records of cases they have filed in Arizona and the only time they have won is by default.  When do their actions become criminal?  How do people collect the fees they are out defending a civil suit filed against them for an account they never had?

Thank You,
Susan in Arizona

October 11, 2007 Nationwide Credit for American Express SCAM

CENTURION MEMBER getting reamed by NATIONWIDE!

Long story but these guys have been harassing my wife threatening the taking of assets through lawsuit. I've tried working out a plan, but they refuse, explaining, it is not an option. I have been charging an average of 200-300,000.00 /MONTH for quite some time, and paying perfectly for years! I can get this cleared up but need some time without harassment, until my closings in 1st and 2nd quarter 08'. Please let me know if you can assist. I really want to clear this debt and move on, but I can't handle my wife calling me in tears again!

Thank you,

October 11, 2007 Portfolio Recovery Complaints Mount Up

Robert, What do you think?

Back in March we received a phone call from Portfolio Recovery Associates, saying my husband had a Capital One Credit card ( opened in1992 ) and the last payment had been made in December of 1998. They said they had bought the debt $1562,29 plus interest of 2,530.17 with 12% interest in the future.  We explained to them this was a mistake and that it wasn't ours and that we never had a Capital One Card . ( We believed it was our middle son's whose name was similar and somehow it got mixed up, of course we didn't tell them that) My son also had this declared in his Chapter 7 bankruptcy in April 2003.
We asked them for validation of the debt by .sending them a registered letter on May 14 But they were a ahead of us and sent us a letter first This letter was mailed  to us on May 7..  What they sent was my husband name, our current address the acc't number and and old address (which I believe was my sons when he lived away for a while This old address didn't even have a state or city attached to it, that we have never lived at and no social security number either .So I think their letter of validation and our letter asking for the validation letter passed in the postal system So the sent another letter .

Their second sent letter went something like this to  Quote them

May 23 2007

"However, since you have submitted a dispute that is substantially the same as a dispute previouly submitted by you and we have responded to this dipute, then as per the Fair Credit Reporting Act,15 USCS 1681s-2(a)(8)(f)(ii), we are notifying you that such a dispute is frivolous and irrelevant
I am writing in response to you recent dispute.
"If we continue to received subsequent correspondence from you regarding a dispute that has already been resolved, we will consider your inquiry answered." No further replies will be forthcoming unless you provide the information we need to assist you, Our Office considers this matter closed"
Sincerely

This letter made us think the matter was resolved and closed. So we did not hear from them from them until Aug 28 2007. Then we get another bill for the same thing. On September 21 We get a letter from an Attorney's Office Strauss, Factor, Laing & Lyons (401) 456-7000 an attorney right here in Rhode Island,,,saying we have 30 days to respond...its signed by Lynda Laing.

Again this is not my debt. I  hired an attorney 2 days after receiving this last letter. I will not pay something that is not MINE Also the attorney that handled the Bankruptcy for my son on this matter is now mine.
Haven't heard anything yet.

What's you opinion.

I get stressed and sick over this kind of stuff real easily.

Haven't been eating or sleeping well, My husband is a retired AIR FORCE OFFICER ,HE SERVED IN VIET NAM AND DESSERT STORM. We are honest people have always paid our bills and have a nice house with 7 grandkids Let me know what you think please?

October 10, 2007 Franklin Squires and Rick Koerber owe me $30,000- And Says They Can't Pay!

Hi.  I just wanted to thank you for all of the great information you have provided regarding Rick Koerber and his money scam.  I invested $30,000 of my mom's retirement money in May and started looking on the internet just two months later when I called the note in and was told they didn't have the money.  Interest payments subsequently stopped as well.  I contacted Michael Hines like your website said and got the ball rolling from my end.  I don't understand why more people are not willing to step up to the plate.  Koerber is the bad guy right?  I can't decide if the people I invested with (neighbours') are bad as well or not.  Anyway, I wanted to say thanks.  I'm worried that Koerber is going to walk on this one too.  What do you think??  My phone number is 801-372-0540.  My email is wendyhendry@msn.com.  Thanks!  Wendy

 Hi, Mr.Robert Paisola,

Yesterday afternoon(oct.4, Thursday). I will provide you more information after I receive their letter.

Wayne (sheng wang)

QUESTION: I bought tihiti village timeshare on a tour Aug 11 to aug 13, we sighned the contact on Aug 11 saturday, I cancled it on Aug 17 friday, they told me I was one day late for the cancelation.(they say 5 days canclation means 5 calendar days not 5 bussiness days).in my cancelation letter, I also mentioned I sighned the contact under high sale press and the sales man lied to us, so I had a telephone meeting among the sales , company manager and me, I asked the sals 3 questions, 1. did you know you can get much lower price to get the tihiti village timeshare else where ? he answered "no". my second question was 2.during the sals , you told us you bought a timeshare in tihiti village too, what was your price? the sals could not answer that question, instead anwer my question, he kept saying " that is not your business".
I really have a bad feeling about consolidated resorts , a feeling like you cannot trust anybody anytime in this world.I now facing the letter they sent to me with the copy of contact on which full of my signatures,l felt like a animal caught bt  a well designed set up.shame on consolidated resorts tihiti village.
Can you help me , robert?
wayne
kansas city,  waynefromkansas@yahoo.com

ANSWER: Wayne,

Here is the deal, I want you to print out this letter and send it to the Director of Sales at the Resort.

Dear Tahiti Resorts,

My name is Robert Paisola and I am a timeshare trainer and train timeshare sales people around the world.

I have a large readership on our international sites at www.mycollector.com and www.allexperts.com

I do not get involved in in issues until they get to a certain point.

So, this matter has obviously reached my desk, (I am doing a training in Mexico today) and every single word that I utter on this site goes worldwide.

So for googles sake I am going to say your name again... The Tihiti Village Resort Scam and Consolidated Resorts.

I would ask, as a professional courtesy that you immediately refund and process this couples money. They are in compliance and it is obvious that the courts will understand that mail is not delivered on Sunday.

So, if you resolve this matter in a proper manner, you will avoid Attorney General Complaints, Rip Off Report Complaints, Division of Consumer Protection Complaints for the State of Nevada, Clark County, and the BBB. BUT you will also avoid the onslaught of previous customers that you have oversold.

Please let this gentlemen know within 72 hours, and be advised that all calls will be recorded and posted on this site, along with the previous outlined call.

Let us know,

www.RobertPaisola.net

Wayne, if this does not do it, I will take it to the next step.

You are in good hands, and Consolidated Resorts will look at the power we have and have no choice but to agree. If they do not we will issue a press release to all of the Las Vegas Newspapers and that will be the end of this deal.

Am I hard core, hell yes, do I protect my clients, hell yes.  Enough Said.

Please take a second to leave positive feedback so that people in your similar situation can learn from your experience!

August 25, 2007 WYNDHAM RESORTS TIME SHARE DOES THE RIGHT THING!

Subject: WYNDHAM - TREND WEST SCAM 70 YEAR OLD MAN- Robert Paisola Responds

 Question: QUESTION:

DEAR ROBERT PAISOLA, MY FATHER PURCHASED A WORLDWIDE WYNDHAM TIME SHARE IN FEB 2007 16000pt THEN IN APRIL THEY CALLED HIM TO UPGRADE IT FOR AN ADDITIONAL 5000pts.  MY MOTHER PASSED AWAY AND HE IS A LONELY GUY HE WENT TO THE WYNDHAM IN PALM SPRINGS, CA  HE LIVES 20 MIN. AWAY HE IS LIVING ON SOCIAL SECURITY AND CANNOT AFFORD THIS.  MY FATHER IS IN HIS MID 70'S.  HE REALIZES HE CANNOT AFFORD THIS AND TOOK A LOAN ON HIS HOUSE.  I NEED YOUR ADVISE please help

 ANSWER: Deb,

So far, every single person that I have profiled on this site that has contacted Wyndham DIRECTLY has been refunded and released.

They know who we are and they have a massive issue with sites like this.

So, Call Wyndham, explain the situation, and explain the fact that he had to pull money out of his home to cover this.

IF THEY DO NOT REFUND ALL OF THE MONEY, CONTACT ME ASAP, AND WE WILL RUN A STORY AND A PRESS RELEASE ON THIS.

YOU CAN SEND A COPY OF THIS TO WYNDHAM CORPORATE.  YOU MAY ALSO WANT TO READ MY OTHER POSTS ON WYNDHAM.

A doctors note saying that he is not capable of understanding a transaction like this would also help. I will post that on our International Site, should they refuse to refund.

 QUESTION: Dear Robert,

I took your advice and called Wyndham direct at toll free number, they told me to have my father write a hardship letter.  Do you think I should follow up with one as well?

The woman I spoke to at owner services said I was probably out of luck but go ahead and try.  What would you do?

THANK YOU  DEB

ANSWER: Deb,

I think that you need to have you, your father and his doctor write a letter to Wyndham. They will release him. They are to high profile and Customer Service is WAY too important to mess with this. I would also forward this letter to them.

August 20, 2007 NCO COLLECTIONS ABUSE ....AGAIN

Hi Robert,

Below is a conversation I had with a debt collector on Saturday, August 18th, 2007. I would like to know if I can be treated this way. Hopefully you can give me some advice or help. I am located in Saint Petersburg, FL.

Saturday August 18th 2007 8:16 AM: Message left on answering machine as follows: Michael Fratone very important you return the call. Legal matter being forwarded to Pinellas County. Very important that you or your attorney contact me immediately to discuss. Can be reached at 888-251-5364. I need to hear from you or your attorney within 48 hours. Again 888-251-5364.

I returned this call at approximately 9:00 am on Saturday morning August 18th, 2007. A woman answered and said hello. I said someone had called and left a message to call this number. She asked my name and I gave it to her. She then said she was calling about a dept for Bank of America in the amount of 9355.00. I said OK. She said I had two options. I could pay 1870.00 down and 200.00 per month to pay off the dept or a settlement of 5600.00. I then asked her for her name and she said Chris Jones. I then asked what company she was with and she said NCO. I told her I could not make a decision today being it was Saturday morning and that I would need to make some calls and talk with some people to see what I could do. She then said let me see if I can get you an extension until Friday and put me on hold. At this point it seemed all was well.

Then another man gets on the phone and starts out by saying we are not going to accept 200.00 per month. I said wait a minute. The woman I just spoke with gave me two options. He then restated her option of the 1870.00 down and the 200.00 per month. Then continued by telling me that I will have attorney fees of 4000.00 and that all my assets will be brought into this. I told him I could not make a decision today and the woman I previously spoke with said I had until Tuesday. (Now the conversation was going so fast that I can’t remember where Tuesday came from or did I mix it up with the 48 hour deadline from the voicemail). He called me a liar and told me that I was being rude. This comment of his was made several times during the conversation. He continued to say that I needed to decide now. I asked him if he had a money tree in his back yard and he said no. I responded that I did not either. I told him again that it was impossible for me to make a decision today. He put me on hold and then came back and said he just checked and said I have 1300.00 available cash on a chase credit card and I could use that. I told him I did not want to do that. He then said he was voiding out all previous options and that I had until 12 o’clock today to make my decision. I asked to speak with the woman I spoke with earlier and he told me she did not want to speak with me. I asked him again if he would put the women back on the phone and he again stated that she did not want to speak with me. I again stated that a decision could not be made today, I said goodbye and hung up the phone. I never did get this man’s name.

Regards,
Michael

August 20, 2007 Allied Interstate Collections - The Saga Continues

Robert Paisola:

My family and I recently moved.  I received a bill for $315 at the end of June, 2007 from my phone company.  On July 6th, 2007 I called Embarq (the phone company) and informed them that I would be moving and need to disconnect my service effective July 10th and receive a final bill.  The phone representative told me that I should not pay the bill I had received, but wait to pay the closing bill which would be sent out after service termination.  This was because there would be a credit applied and the actual amount would be lower.

On August 7th, 2007 the closing bill was cut for $255 due Aug 31st.   On the same day, a collection letter was cut from Allied Interstate claiming I owed them $315.  The letter indicated that I had to notify them within 30 days if I disputed the debt.  So I called the phone company to verify that the correct amount was $255—they said yes and they accepted my payment over the phone.  The representative at the phone company said that based upon the notes in the computer record, the account should not have been sent to collections—in any case, the account was paid in full and closed as I requested.  They have since sent me a letter confirming all of the above.  They told me that they would inform Allied Interstate, but also advised me to contact Allied Interstate directly and inform them of the conversation I just had with the phone company.

When I called Allied Interstate, I spoke with “AJ.”  He almost immediately started “talking over” me.  After several requests, he let me finish my initial statement.  To which he replied that I was not telling the truth.  Several times during the conversation he repeated the claim that I was not being truthful.  I asked to be transferred to a supervisor.  He replied that there were no supervisors on duty at that time.  Later he told me that HE was the supervisor and that is why he didn’t transfer me.  I asked him for his name—he would only give me “AJ.”  Then I asked for an employee ID number—He said they didn’t have ID numbers (I found out later that this was untrue).  I asked him to acknowledge that I had instructed him not to call me concerning this account in the future—he would not.  I asked him to acknowledge that I had informed him that I disputed the amount on the letter they sent—he would not.

This doesn’t rise to the level of difficulty that many have had, but the tone and MO are the same.  I have reported my experience to the appropriate State Attorney General’s, the Better Business Bureau, and the phone company involved.  I hope this is all over.

August 19, 2007 American Express and Nationwide Credit ...Again

Hello,

Friday I had a very unsettling conversation with these folks at Nationwide Credit. They have my AMEX in collections. The balance is $10,013. I was able to have the account held  by promising a $200 payment on Wednesday.  They want me to borrow more money, get a cosigner, etc., etc., to pay this bill in full. I told them that borrowing money to pay off credit was what  got me in this position in the first place.

I am supposed to call them back by Monday, August 20 between 3:30 and 4:00 EDT and let them know what I have been able to do to pay off the account. Well I am not willing to borrow any more money, and frankly with my debt to income ratio it wouldn't be possible without a cosigner. I am willing to negotiate a payment plan, but they insist they don't do that, which I am certain is a lie.

I am not sure if you will be able to answer this by the time I have to talk to them on Monday, but I was wondering if as long as I am making monthly payments if they could pursue litigation. I believe that they have to consider a reasonable offer, which I am prepared to make. Any advice?

August 19, 2007 Fairfield Resorts and Wyndham... Again

Dear Robert,

Several years ago, my husband and I purchased a small amount of timeshare points with Fairfield Resorts, now Wyndham Worldwide’s subsidiary.  We have since “upgraded” to VIP Gold status, with a 500K point ownership.  The payments were manageable for that amount.

Foolishly, we “upgrade” once again to the VIP Platinum, with 1,154,000 points of ownership.  We are making the payments, though they are just more than we prudently should be making.  With the taxes and maintenance fees, we’re paying $1900.00 a month.

Prior to our foolishly making this last upgrade, I’d been injured, am now partially handicapped and had resigned from my full-time teaching position.  Even though my health has not improved, I have felt forced to return to work so that we can handle this excessive payment – one we took on; it’s our own fault.  I am ashamed to say that we had stars in our eyes about all the vacation time this would allow us – for which we really can’t take that much time.

So, I am wondering if we could stop paying and have them repossess the deed.  I know that they propose to prospective customers (during the presentation phase) who are having a hard time with the purchase price that there are deeds, for less money, that they have “reacquired.” They deliberately refrain from saying repossessed and allude to other owners having traded this for another deed.  This may merely be one of their lies in the presentation process but I believe there must be plenty of others like my husband and me who have “bitten off more than they could chew” and it is from those that they have this reduced-priced inventory.

What, if any, experience have you had specifically with Wyndham?  Locally in Virginia Beach, there is a timeshare company at the oceanfront called Gold Key Resorts.  I know several of the sales and finance people there.  They have all counseled me to stop paying and that the deed will be repossessed and that’ll be the end of it.  I wonder if, being that Gold Key isn’t a global company, the expense of pursuing legal action outweighs their gain from reselling the deed and if Wyndham would pursue the legal action since they have far more resources.  Can you help us?  I am most interested in hearing what you can do for us, suggest to us, etc.  I fear that we are stuck until the market improves and we can sell this to someone else who can both afford and use it.

Thank you in advance for your time and attention to my query.  I look forward to hearing from you.

Yours truly,

Anita C. Edwards-Struewing

August 17, 2007  Your Seminar Changed My Life

I saw you today in St. Louis, and was most impressed by you and what you had to say. I’ve always believed Real Estate is the best investment. I dream of investing in it someday.

I am a single mom of 6 children. The road I have travelled has been long and complicated. I have been through two divorces and a bankruptcy with each. My first husband was an abusive alcoholic and abandoned us when I was expecting my fourth child. The second marriage was pushed to the brink when my former husband took all our home equity and assets and put them into his families failing computer hardware company. The equity in the home had been a trust given to my children by my father. During one of the second mortgages my former spouse had arranged to exclude the trust from the title and the trust was lost. We were headed for foreclosure when we separated, so my father purchased the home and allows me and my children to live in it. The house was originally purchased for $300,000. By the time my father purchased it the mortgage was $400,000. The home is now valued close to $600,000. The verbal agreement I have with my father is: he will get $400,000 + any costs of maintenance and repairs + $2500 each month I live in it (the monthly mortgage cost) when the house is sold.

There are several reasons why we don’t sell at this time. Some are legitimate; like size for a family of seven. Some are circumstantial; like I have a child with Cystic Fibrosis and her monthly cost of health insurance is over $900 which is also being paid by my father. Some are emotional; like my father refuses to discuss alternatives until I have sound options. I feel stuck and powerless.

I continue to attend seminars and motivational events to stay positive and inspired. I know in my heart God wanted me to make personal sacrifices for the good of my children. In spite of physical abuse, alcoholism, and the turmoil of divorce, I have raised outstanding children. They help support the household by working hard and paying for most of their own expenses. One of the reasons I keep the house is because we save money on college by the older children living at home and attending a junior college. They are truly some of the most loving and empathetic people I have ever known.

I am proud of my parenting, but there has been a cost. I have not provided well for our financial well being. I have no money or financial skills at the age of 47. I am determined to develop this area of my life. I have worked hard and regained security in all areas but finances, and so my focus is on achieving financial security. I was wondering if you offer scholarships of any kind for you seminars. If so I would love to be considered.

August 17, 2007 Thank You Robert Paisola

My sister recently had the great opportunity to hear you speak in Saint Louis

She was very inspired and motivated to share your success story with the family. Our family is a very close knit family and we have been tossing the idea around about starting a family business in real estate for awhile. Our priorities have recently changed, my father lost his job this year after working with that company for 15+ yrs and my mother was diagnosed with treatable breast cancer and is currently ongoing treatment. So you can imagine how these experiences bring everything to the forefront. My parents owned their own business for 10 yrs in telecommunications in Arizona, unfortunately due to inexperience and no guidance or success coaching, their business failed. We are eager as a family to pull together and use our resources and knowledge to create a family owned business, that can be maintained and operated for generations to come. We are very eager to take your course, my sister wanted to discuss her experience of hearing your VERY motivational talk with us and see where we stood on taking the course etc......She did not sign the roster for fear that she wouldn't be able to take the course, she thought there was a corporate discount or something about bringing an extra person or something along those lines, she is unclear of the details. Is it too late to sign up?

I am looking forward to hearing from you,

Warmest Regards,

August 17, 2007 LDG SERVICES GOES OFF THE DEEP END ... AGAIN

We talked with LDG Services today to a Person named Melissa Cory, who got super angry because I asked her name and the spelling of it and she is the front person for this phone contact.  They call from 813-283-200 and then you can't call them back.

They have a recording that wants you to call them back at 1-866-281-7743.  We thing we are getting calls from our grown kids or grandchildren and it is these hateful computer recordings.

We are listed on the Federal Do Not Call List to stop all the garbage that assaults us and we are trying to stop the spam and the junk mail at home.

Finally after getting angry because they forever and then suddenly decided to  put me through to a person of Thomas Holcom who is the Manager.

When I asked him who he was he said I'm with LDG Services.  I asked him what it was and he said a collection agency.  I said where are you located and he said two places, why.  I said I want to have my attorney contact him and he said, that he would contact my attorney.  I told him, my lawyer would not appreciate a call from a stranger and this is true of both of them.  Neither have time to talk to a fast dancing nebulas person that is hiding and will not even tell me what they are having a computer call our house ever since Spring of this year.

We are about to the point of having the phone disconnected as my wife is a nervous wreck fro these nebulous recording that state, "call us". Why should we?

Then he said you have a problem with Verizon and they have contacted him to do something for them.   I asked him who and he would not tell me.  He told me to call a local office and then get the 800 number and track down Verizon wireless.  He said that this all started around 3-29-07 and as Florida was a Debtor State that they will call me from all over the United States whenever they feel like it.  He said they or someone else was also doing this to us.  We checked our credit report and sure enough this is true.

I have no idea where this is all headed since two years ago, we returned some phones to Verizon and have the paperwork to prove it.  All because of some overcharges as our Childs phone was stolen and then she used her mothers to track it down from some horrible dope dealers in Tarpon Springs, off the Pinellas Trail.  Our daughter, thank God is now in a recovery program and is to finalize that next year

I will likely use some of this information I'm sending you to send to the credit report people as we are contesting the changes by Verizon as you can never talk to anyone who has an education but is a book follower and if it's not in their script they don't know what to do so they keeping increasing a small bill and then bill you more money and never actually provide customer service in the real sense.

This guy I talked to today said that he is going to put something into the works as I "Refused to Pay" and I don't even know what I am supposed to be paying for or to whom?

This is the most clandestine thing I have ever experienced in my life. I am going to share this with the local news channels and also with Verizon if I can find out who to talk to.  This will be the true challenge.  Talk about the asterisks on commercials!  Yes, what is it, what is it, what is it?

 Sincerely,

 James Hooker

Hello my name is Heather Smith. I received a phone call today from a Patricia Coleman at Creditors Interchange. She stated that if I do not pay my balance off by 8/31 then they would take me to court and garnish my check as well as take out a lien. I asked if I could break the payment up so that I could get this taken care of and she said no that I have to pay it in full. She said that she was going to call my HR dept and if I ended up going to court that it would go from $720.00 to $2300.00. I want to work out a payment, but she said I do not have that option. Is this true? What options do I have? Can she threaten me like that?

August 17, 2007  An Example of a Corporate Account Billing Dispute - Why we do not collect on Consumer Accounts!

I really hate to keep going back and forth on this as well, its always difficult when a client doesn't want to pay for services they agreed too. If we decided to take William Lyon to court, could we could have Saudia and Shannon testify under oath that they knew exactly what they were authorized to "approve" and that they knew if they did not place any orders through the system that they would be billed for our programming hours?

I explained this to Saudia and Shannon on several different occasions explaining to them how we do business, and Saudia and Shannon were in complete agreement.  It's not our fault that William Lyon did not initiate the correct training of their employees on how to use the cyberdocs system and therefore deciding not to use a fully functional system that they themselves requested. In speaking with our head legal counsel Paul Fosco he advised me of a legal concept called "apparent authority". If one company (DX) is dealing with people from another company (WL) that appear to have the authority to act on behalf of the corporation (Shannon and Saudia), then their decisions will bind their company. There is no need for us to independently verify whether they actually had the authority or not. William Lyons position on that issue is pure BS. Paul is confident that her e-mail would be completely detrimental to their case and would probably be considered a judicial admission of guilt relative to this issue if litigated.

i never once dealt with Mark Carver, in fact I don't even know what his daily functions are at William Lyon.  All contracts were held Saudia Casper.

Everything went through Saudia and Saudia and Shannon knew that if they did not order through our system after we performed the programming requests that William Lyon requested that they would be billed for our services.

Saudia and Shannon both told me this many times that they knew exactly what the agreement was.

If we have to we are prepared to go to court for money we feel is rightfully deserved. We want to explore every avenue if that is what it takes to get payment from William Lyon.

Please let me know what your thoughts are on this situation.

August 15, 2007 We saw you in St. Louis- Can you help?

I saw you in St. Louis yesterday and was impressed with your concern for others. Our not-for-profit community treatment centre focuses on the mental, physical, social and SPIRITUAL recovery of chemically dependent children and adults.

We are soliciting funds to build a serenity chapel on our 18 acrea campus. The total cost would be about $80,000. We have raised about $31,000 and need the remainder.
Will you please assist us. I encourage you to go to our web site-- www.comtrea.org to see more about us. Our Athena center provides the same or better quality of care as the Betty Ford Center but at 1/5 the cost!
Thank you for your caring.

August 16, 2007  I loved your presentation..thanks!

I loved your 'talk" today. And was very inspired, I got some deals line up and need a little help. If you can give me a call and we could work something out. Thanks so much, Daven

August 17, 2007  "You Rock Man!"

Mr. Paisola

I just attended an event here in St Louis today and couldn't wait to get home to write you. By far i thought you were the best of them all. I sat on the edge of my seat from the time you first open your mouth till the your final word. I'm still in shock & in a daze because the way you think, your ideology, words of expression, how you enter act with the poor & help them at the drop of a hat & the way you rise your sons is so consistent with my way of life & to hear someone else say the the same things iv been saying & doing for years scared the heck out of me. you go left when every one go's right, you love being different than others and I believe when you said that God put us/me in that dome at that moment to hear you & all the others is a confirmation that I am on the right track to major success's have a beautiful home with not a dime to my name and I cant wait till the day comes when i give my 2 weeks notice to my job that i will no longer need because of the wealth that this real estate game you artistically spoke about. When hear that your class cost $5,000 ,my hard fell in my lap because I knew that there was no way i could afford that fee. I have paid for knowledge & training many times over and if i could have i would have been the first one to sign on with you. I feel that im left sort of dangling, pumped up with all this energy ,greatness & hope from you presentation yet I don't have a means to meet your requirements in order to gain access. Please don't get me wrong, my real estate investment future doesn't end because of this matter because i'm going to get there some how, but you got the juice baby & being under your companies wing would have gotten me where i should have been long ago just that much smarter & faster. Ether you must have been in my head all these years or i may have met some kind of spiritual soul mate in you sir. I'm not nor will i ever be your average being, I am willing to bet my mortgage that 90% of the thousands you spoke to today wont apply this gift you have given us today, but i will even though all of what you said is probably 2% of what i need to do in order to become successful in real estate. I have no doubt that you will be contacting me later on & not just ignore my e-mail because i was setting at the very top of the seating area and i felt your spirit pounding my chest from that great of distance. It takes a lot to move me & you did just that, you explain explained every thing so crystal clear. I loved it how you put the demo's & repub;s on full blast knowing home land security was in the house but you did it anyway. ( Robert Paisola  for president) LOL. Anyways ,it's late and i have to hit the 9 to 5 in the morn but you take care, don't ever stop helping the less fortunate cause I wont and if there is any advice you can give to help me along the way, i thank you for your response in advance you rock man.

August 17, 2007  Your Seminar in LasVegas

I met you briefly at the seminar in Vegas a couple months ago and I have an opportunity that either you or some of your students may be interested in. My primary lead source for mortgage is an Employee Assistance Group that services 25 million employees. We have clients referred to us just about everyday that are going into foreclosure and I do not have anyone to refer them to. I figured that this would be a great opportunity to talk to people that would be willing to sell their property before being foreclosed on and then turn around and rent it back to them if they were interested. I would like to chat with you more about this when you get a moment.
Take Care,
Casey Jenkins

August 15, 2007  The "Law Offices" of Donald S. Burak

Mr. Paisola

I was just reading on your website about a situation similar to mine. In Nov. 1997 I leased a car so that a friend could use it who promised me (orally) to cover the payments but did not do so. I could not afford the payments myself and when the First Union (now Wachovia) kept calling me I told them to just take back the car and leave me alone. My friend had it in PA and they took it and sold it somewhere but there was a deficiency around $6000+, and they kept calling me about that, and later they sold the deficiency to Troon Company collection agency. I was making small payments to them and I think the last one was in 2004 or earlier. Due to tight finances I was unable to continue payments and did not hear from them until just this month (see letter below). Should I be worried about this? Did my payment to Troon in 2004 reset the clock? I don't have much assets, I owe $5K on my car which has 180K miles, and I make just enough to get by.

I plan to write to them and say I dispute the debt and that the lease contract is past the Statute of Limitations and not to contact me again. Can you advise me on how to word it? Remember, Troon Company is not the original creditor, it's First Union (Wachovia).

NOTE: if they offered to settle for $500 or so I would be tempted to agree to it. Letters from lawyers make me sick to my stomach and lose my appetite and be unable to function normally. I went through this last year with Chase and ended up paying them 70% of a $3000 CC acct. I can't afford to hire an attorney.

Dear Robert Paisola  The Electronic Frontier Foundation Steps Up !

At a packed San Francisco hearing today, the Electronic Frontier Foundation (EFF) defended your Fourth Amendment rights and urged the 9th U.S. Circuit Court of Appeals to let our class-action lawsuit against AT&T go forward. The case demands that AT&T stop illegally assisting the National Security Agency to snoop on its customers' telephone and Internet communications.

There's much more at stake here than stopping the Bush Administration's illegal spying and holding the telco giant accountable, though. The President is arguing that thin claims of "state secrets" can trump the courts' constitutional duty to uphold the rule of law.

Without judicial review, there's no way to protect ordinary citizens against government abuses of power. No president, now or in the future, should be allowed unfettered authority to evade the courts and trample on your freedom. As Judge Vaughn Walker wrote in rejecting the government's claims at the lower court, "The compromise between liberty and security remains a difficult one. But dismissing this case at the outset would sacrifice liberty for no apparent enhancement of security."

For the past 17 years, EFF has been proud to take on the hard cases to ensure that your liberty is not sacrificed unnecessarily. Please support us in this critical case by donating to EFF at http://secure.eff.org/att .

And please spread the word to your friends and family.

August 15, 2007 DOCUMENT EXPRESS DISPUTE

Subject: Document Express - collection response

Good morning Mr. Catlin,

I am writing in response to a debt you are attempting to collect on for Document Express, File # DE8173.  I have attached a copy of your original collection email, a copy of the invoice we have from Document Express and a highlighted page of our executed agreement with Document Express.  Please take some time to review the items I have highlighted from our agreement with Document Express.  It clearly states that if we are to be billed for custom programming, that we will receive an estimate of work and charges and Document Express will not begin custom programming without our authorization.  We do not have any knowledge that we were given any type of written estimate for custom programming (required by our agreement) and we do not have any knowledge of executing the written estimate (required by our agreement).  Please research this and let me know in writing what you come up with.  I appreciate your time and look forward to hearing from you.

Thank you,

August 15, 2007  Allied Interstate and Intellirisk

Dear Robert Paisola,

Hi, my name is Stephen and while doing some research online I came across the following website (http://www.ripoffreport.com/reports/0/191/ripoff0191302.htm ) which provided me with your name and email address.  I am hoping that you can spare a few minutes to explain the relationship between Intellirisk, Allied, Coldata, and HRI Consulting to me.  Are they all the same company?  From what I can tell Coldata was terminated in 1999 and acquired by Intellirisk, but I'm not sure how the others fit into the mix.  I know someone being harassed by HRI Consulting and because they have an office in the same building as Coldata I was wondering if they are really one and the same.  Any light you can shed on this would be most appreciated.

Email me back or call me at any time to discuss this.

August 15, 2007   WYNDHAM TIME SHARE AND BLUEGREEN RESORT

Dear Mr. Paisola,

I am writing because we were owners of a Wyndham timeshare (Ocean Blvd)  and a Bluegreen timeshare.  We attended a meeting in July while on vacation in Williamsburg (Wyndham).  In this meeting we were told that we could reduce our membership fees, increase our ownership, and combine our Bluegreen resort if we simply transferred our ownership from Ocean Blvd to Star Island, Orlando, FL.  There was a big spiel on how it did not matter where you owned, etc, etc.  We liked the idea of less fees and the ability to combine both timeshares into one usage.  We foolishly agreed, but upon reading the contract we found there were some things that were not entirely disclosed or were misrepresented during our meeting.  We tried to contact our Rep, but ,of course, were unsuccessful.  We then, as per contract, sent a certified letter requesting to not go through with the sale and to resume our old contract.  We heard absolutely nothing for 2 weeks.  At that time we received a letter stating that we had only 7 days to change our minds, but we could; however, send another certified letter claiming any misrepresentation or failure to disclose info...the catch was that our 30 day period in which to do that would run out in 24 hours.  We wrote a letter, faxed it and sent a certified copy.  We hold that one of the undisclosed items is a mention of Club dues, and taxes, to be paid over and above the maintenance fees.  The taxes were mentioned and an estimated amount, but the Club fees were no where to be found.  Of course, all of these fees are subject to go up and our usage would never increase, but may very well decrease.  Upon making an effort to go about resolving this and getting absolutely no assistance from Wyndham, we have now decided that we do not even wish to go back to our previous contract...we just want out.  We have seen just how accommodating they can be, and how when you have a question they simply refuse to answer, but they make no bones about demanding that you hold up your end of the bargain..never mind if they don't hold up theirs.

We are considering just cutting our losses and refusing to pay.  What recourse do we have?

Sincerely,

Robert and Lisa Smith

August 14, 2007  HILL ERICKSON AND FRANKLIN SQUIRES - FREECAPITALIST.COM.. THANKS ROBERT PAISOLA, YOU SAVED US!

Thank you for your web site. You might have just saved me a huge headache. I am having trouble selling a home and Hill Erickson offered to step in and purchase the home via seller finance. After doing my research I do not think I will go forward in deeding the house to a company who's parent is under investigation. Do you know of any other people who have had trouble with the Hill Erickson portion of Franklin Squires? I would gladly appreciate any information you have on Hill Erickson in particular. I am willing to share what information I have received from Hill Erickson.

 Thank you again.

August 14, 2007   WESTGATE RESORTS SCAM

I recently read your answer to Donna about West Gate. We were recently on vacation and were offered free tickets to listen to a presentation that lasts about 90 minutes about West Gate timeshare. We were approached on the street and were asked to put up a deposit of $20.00 and were told that we would get it back. We should have known that was sign of a scam at work. We listened to the presentation and saw the facilities. This was a very nice facility and we would probably had suggested it to someone else if we thought it would be something for them. The salesman was nice at first and very informative. He told us up front that he was not going to pressure us into buying anything. After listening to the presentation, we told him that this was not something for us. We don't take many vacations ( only day trips) and do not have the extra money for buying somthing of this expense. He went to get his manager so we could get our free gifts... His manager came over and started on the sales pitch of how much we could buy a unit for. When we told him we were not interested, he started talking down to us about how we were putting the salesman's job in jeopardy by listening just to get free gifts. He said that we definitely didn't look like a couple that needed a free vacation. My husband is also a salesman and if his boss talked to any of his potential clients the way Mr. Mike Burkitt talked to us he would be out of business. Then the salesman we talked to made a complete turn around.. He acted like we were intruding and treated us very rudely. We hope no one else has to experience the rudeness that we went through. Maybe this is a tactic to upset people and make them leave without what they had been promised. But as I said earlier this was a very nice facility and we might have recommended it to others, if we had not been treated so rudely. I hope when you train salesman , you teach them that treating people like they are your best customer, might change their mind later. We will never go to another timeshare presentation again after this trip.

August 15, 2007  CAR REPOSSESSION - CRESCENT RECOVERY

Robert,

I got your email address from a website that was giving some really good information about old debt collection. I am hoping you can help me with my issue.

In April 2001, I filed bankruptcy. I had a car at the time and wanted to keep it so I told the court I would try to keep the car. After about 40 days it became oblivious that I could not keep the car. So I called my lawyer and told him I wanted to turn the car in.

He wrote a letter and about 2 weeks later the cops came and got the car. The car was sold at Police auction and that was that. I never seen it again nor was I contacted about a debt again. I was told at the time, over the phone, by the loan company that I did not owe a dime. This was 2001.

In 2006 I went to refinance my home and seen a company on my credit report claiming I owe $17000.00. I sent a dispute to the Credit Company and next thing I know I get a letter of rejection from the credit company stating that it is a real debt. I did not recognize the name of the company so I called. It was a company called Crescent Recovery. They purchased the debt from my original car loan company who is not out of business.

They said the 17000.00 was debt plus interest from 2001. I told them I did not owe the debt, that the car was picked up as part of a deal and that was that. I never heard from them again until tonight and yesterday via mail and phone. Tonight they called again saying I owe 18000.00 plus. Now we are in 2007….. They still appear on my credit report and they won’t prove to me how I owe anything at all. All they say is you owe us! I asked them to take me to court or send proof.

I want them off my credit report and I am never going to pay 18+ - ever…. So what can I do? I got a letter yesterday stating they wanted to make a deal. So I am guessing that they know they have no proof…

I think the statue of limitations is 10 years in Louisiana. That is where I got the car and signed the loan.

I am moving to Tennessee in 2 days. Can you help?

August 08, 2007- Unifund Abuse Continues in Georgia

Dear Mr. Paisola:

I have a relative in Georgia who is being sued by Unifund CCR Partners for a Goodyear debt for $835.00 plus interest of $254.24. She isn't represented by an attorney because she can't afford one. They have told her that they will win in court and then they will garnish her check. She is a single mother and only works part time. She is willing to settle the account for $540.51 in monthly installments of $91.00 per month over a six month period.

What should she do? Her answer to the complaint is due this Friday, August 10. She is going to put in her answer her willingness to pay the above amount.

Sincerely,

Denise

August 07, 2007 - AMEX AND NATIONWIDE CREDIT- HERE WE GO AGAIN!

Hello Robert,

I enrolled in a debt management program due to financial difficulties and all of my creditors agreed to the terms besides AMEX. I have 2 cards a Platinum and a Gold charge. AMEX wanted to settle with me for 75% of the balance and at that time i did not have the full balance. Now I'm in collection (primary stage) with Nationwide Credit and they are telling me that they can only settle one of the accounts, the Gold charge with balance of $1200 and they will take 60%, but they will not settle the larger balance of $3600 on the Platinum card, according to AMEX's terms. Supposedly they tagged this account as "not to settle" My question is it possible for them to want to settle one account and not the other, can it really be AMEX terms, when they originally wanted to settle? Also, they want settle the smaller account if I don't put anything down for the larger balance, can they do that?

 Please help!

August 07, 2007- NCO IS CAUSING ME TO LOOSE MY BABY UNDER STRESS

Hello, my name is DaJohn Ross and I was completely, and still in awe after reading a post you listed stating that the NCO company is a scam. There reason being is they are currently taking money out of my account for a debt that I due owe, but I was explained to by another person with a consolidation program that it was odd that the company that actually has the account is not the people that I am currently paying the money too. So it would seem to me the holder of my account is still looking to put my wages in garnishment while I am paying a scam company my little bit of funds I have. Please help me. I am young I am pregnant and I have only a little sanity left, and I am trying not to get too stressed and lose my baby.

August 02, 2007- UNIFUND ABUSE AND SESSOMS AND ROGERS

Hello:

I am being sued by Unifund and have done a lot of work on my own.

However, I believed that I can not handle this without an attorney.

I am in Rockingham County, North Carolina and the trial date has been set for Sept. 24th.  I had an order from the court to pay attorney fees to Sessoms & Rogers from Durham, NC.  I did discovery and nothing from Unifund will hold up in court, it is all hearsay. I filed a MTS the evidence and a MSJ.  The judge did not listen to me at all.  The judge refused to hear the MTS and then denied my MSJ.  Then I was slapped with

a court order to pay Sessoms & Rogers attorney fees because I did not answer Sessoms & Rogers interrogatories.  I did answer them as fully as was possible for me.  I told this to the judge and the judge wouldn't listen to me. The judge simply took Sessoms & Rogers word over my word without any evidence.  It is clear that a Pro Se will not be listened to in court.  Discovery papers are not filed in North Carolina.  BTW:

Sessoms & Rogers did not file an opposition to my MSJ or enter arguments against my MTS or MSJ.  Yet, my MSJ was denied.  I am being railroaded by the court system here in Rockingham County, NC.

If I don't get help, I will lose to these scumbags.  The law firm of Sessoms & Rogers are no better than Unifund.  They will lie and cheat their way through.  I have no idea if I can get the court order to pay attorney's fees vacated.  It was $800.00 ($200 X 4 cases)  I only work part time at min. wage.

Please help me or point me to an attorney near me that can help me.

Thanks,

kimberly_anne@gawab.com

Westgate Resorts - One Big Big Scam

My husband and I were "pressured" into a partial deal with the Westgate people.  We signed up for the vacation traveller.  We were told by Nathan Blanton (at Gatlinburg Westgate) that after we went for our one week stay at any other resort and that if we did not like it and did not then want to buy into the timeshare that all of our money would be refunded and that the vacation would be on them.  He said "You can't lose!"  Needless to say, after a year of dealing with finding out our daughter had Juvenile rheumatoid arthritis and many other problems, we go to take our one week stay at Westgate Lakes and guess what we are told when we say we can't afford to buy in right now?  We NEVER refund anyone's money.  You must have been mistaken.  Since we don't have that part in writing I guess there's nothing we can do, huh?  Just add us to the list of people who HATE Westgate.

Another Victim of Kavin Austin Blake

Hello,

My name is Steven DeBay. My wife and I are in an absolute disaster because of Austin Blake. We are being foreclosed on one house, with another to follow. I knew about your website a couple of months ago but did not respond because you had said on the site that you were not interested in those who had made bad real estate decisions. I know that we have, as this was our first and last real estate investment. But we are about to go from a perfect credit rating, never even a 30 day late, to now complete ruin. Austin just simply kept telling us that everything was wonderful, even up to our closing the construction loans. We told him that we wanted our money back, and that we did not want to go forward, but he said that we would not get any of our deposits back if we backed out. He said the homes were selling no problem with everyone making very good money. The appraisals were at 365,000 last April, and by the time it was getting close to begin selling them this March, we were told by realtors that they were only worth 250,000.I don't know if you even want to talk to us at all. We are simply responding to your website and letting you know that we are out here and we are devastated by this man's actions towards us. He was an absolute arrogant person, but we were sent to him by our real estate group  that recommended him. They now say they didn't know we were involved and would have notified us as they did others not to continue dealing with him.

INTENATIONAL PROFIT ASSOCIATES

July 29, 2007

I decided not to continue with IPA before we received the first visit but the senior analysist decided to have the team meet us at our office the following day we told him we were hesitant and wanted to think about it… I did sign the docs coerced of course and deceived that if we did not continue we would not owe anything…

They came and it took 1 hour of us telling them we do not want to continue and we want to think about this for them to let us continue with our regular business, at the end it took them 1 hour to give us an invoice for more $7000, we gave them 2 checks one of $1500 and another of $5500, we have put a stop notice on the $5500 check but are concerned that pretty soon they will be harassing us and threatening us…

Any guidance is appreciated… we are in California…

ALLIED INTERSTATE HARASSMENT

July 27, 2007

From: Gary Kendall, PO Box 6017, Boise, ID 83707

I am presently being repeatedly telephoned and harassed and abused by agents/representatives of Allied Interstate.

Said agents have gone so far as to threaten my health, life and actually incite onset of my medical symptoms, despite being previously told to cease calling me because of the life threatening nature of my conditions.

I am at continued coronary risk and suffer from stress induced seizures/migraines/nausea attacks and a host of additional, painful and debilitating symptoms associated with the Post Concussion Syndrome caused by my active duty military incurred severe, closed head injury (traumatic brian injury).

I have sent a legal "cease and desist" letter - appropriately citing the federal Fair Credit and Collections Act - which Allied is ignoring.

I would like to be listed as a member of the plaintiff class in the action you are pursuing.

Please let me know ASAP should any further information or forms be needed.

Another Victim of Kavin Austin Blake

July 27, 2007

I wanted to add my name to the list of people that had dealings with Austin Blake.  I am a CPA in Tucson, AZ and entered into a transaction based on representations made by Austin Blake.  They included a $5,000 investment, a builder would start and complete construction with in 9-12 months of the contract being signed and no out of pocket costs until the property sold.

The $5,000 investment turned out to be approx. $7,500.  I incurred interest carrying costs that were not funded thru interest reserve of approx. another $10,000 and though I signed the construction contract thru Austin on August, 2005, the house was not started until mid 2006 by Castle Builders and has just been completed.

I also believe that REFLECTIONS MORTGAGE should also be looked at along with Bayside Title.

If you need anything further, please let me know.

Another Victim of AMERICAN EXPRESS

My mother and I have an American Express account that is in default.  We owe $10,000 and paid $500 7/23/07 and today 7/28/07 another $500 (pd via Amer Express's website).   They said that they would not accept payments and have given us phone numbers to financial lenders to apply for additional credit to pay off this account.  They have threatened filing a judgement against us.  My mother has very good credit and they keep telling us that we have this amount available on different accounts to pay them.  At first we were going to do this.  But it just didn't seem right to create additional debt in order to pay this.  They also want us to send payment to via Western Union.

So I began to research this issue via the internet and am amazed by what I have read.  As a result I have created a letter to send GC for them to cease calling my cell phone, and my work.  My mother's letter is asking that they cease calling her home.  I want  to fax this letter and mail it.  But I can't find any information on them.  I called and asked for their address but they said I had to talk with the person handling our account because we may not have "mail privileges".  When I asked again for the address I was hung up on.

I know they office calling us is out of St. Louis, MO because of the area code.  Also, are they allowed to look over our credit reports and tell us what credit is available on our other accounts to use it to pay them?

Your assistance is greatly appreciated.

Another Victim of SR FINANCIAL ON A 20 YEAR OLD ACCOUNT

Mr.. Paisola;

A couple of months ago I received a call from S R Financial trying to collect a 20 year old debt from Bank One ( now owned by Chase). I advise that I was not sure of the account and that anything that old was past Statutes and I was not interested in talking to them. Last month I co-signed with my son to buy a car and low and behold SR Financial placed the account as a collection that states the  account went delinquent 2002 was assigned to SR 2005 and reported as a collection 6/2007.

To get the car loan I went to Chase and they wrote a letter to me and the Credit agencies stating the debt was not mine. I was able to get the loan. I then went to Equifax to get removed and provided all info.. They investigated and stated the debt is mine.. Great but their diligence was flawed in the fact that SR Financial illegally "re-aged" the account.. I have gone back to Equifax and stated I have not had a Bank One account in over 20 years and they should re-check their info.

Should I send a copy of the Chase letter to SR Financial? Should I continue to ignore them? Do I have legal recourse against them for illegally re-aging the debt? What do you think is my next step.? My FICO was 788 six months ago and is 650 after the collection.I believe this is damaging my credit and financial well being.;l

Thanks
Bob

Another Victim of PLAYA DEL SOL RESORTS

Could you help me? I know that you are very busy so I will keep it brief. This happened in January of this year, (2007.) The sales Manager at Costa Sur, Candice Ross, 100% sold me on this scam by making it sound like an unbelievably good financial investment. a "no brainer," as she put it. At no time was it anything else. I even told her that I would never stay there since I could find apartments in PV for cheaper that were privately owned and that this was strictly an investment for me. The heartless witch even looked excited for me when I mentioned that I wanted to help my mother with her life because she was struggling financially, since her divorce. I told her that the money she was asking me to invest was my life's savings and that it was going to be used for this fall's tuition. She promised me that if I talked with her Broker friend, I would have the whole thing paid for and have money to burn on anything I wanted in 3 to 4 months. This would be accomplished using the 50 free weeks that came with this "amazing" deal as rentals for 3000 US each week. Everything that was verbally promised by her was cancelled out in the written contract that explicitly stated that it was the default contract and that the Corporation was not responsible for any verbal agreements or promises made by their own sales reps! It further stated that I had purchased this thing strictly for vacation pleasure and in no way desire to use this as an investment. Can you believe this? I had already spent 5 hours in the Boiler room and was completely frazzled at the point the contract came out. They also told me that I had to waive my rights to the 5 day cool down period because this was a resale from someone else's upgrade. In the end I paid the down payment of over 4000 US dollars and am supposed to pay them 200 Canadian every month for the next 7 years! I have blocked them from my credit card because they unauthorized my payment plan in order for me to pay them the total owing through I loan I was getting. When I realized that they were going to do this I had them send me a conformation email in writing, which I now posses. Then I blocked them from my card and never paid them. They are now threatening me with collection agents and things to pay them my over due amounts. After I paid Candice's broker friend the 500 US dollar initial fee for their services and gave them 10 weeks to rent out, I never heard from them again. When I would call they would just tell me to keep waiting. I called Candice back from Canada to see what was going on with this and she didn't remember me but told me that the broker was good and that she had done this hundreds of times and not to worry. I just want Playa Del Sol to give me my money back and rescind my contract. Can you help?

Sincerely,

Another Victim of RJ Boudreau, "Attorneys"

Hello,
My name is Chris Simmons.  For the past 4-6 months, I have been receiving phone calls several times a week from R.J. Boudreau & Associates.  They keep asking to speak with someone named Frank D'Ambrosia, whom I have never heard of.  They are calling my business cell phone, which was issued by my employer.  I have repeatedly requested that R.J. Boudreau remove my phone number from their database.  I have told them that I do not know Frank, and asked that they cease and desist calling me.

Yesterday I went through the same routine again, and once again they agreed to remove me from their list.  Today I received another phone call from them asking for Frank.  This is driving me crazy!  I can't believe that what they're doing is legal.  I don't want to go through the hardship of changing my cell phone number.  Can you please recommend a course of action?  What can I do to bust these jerks, or at least get them to leave me alone?

Another Victim of PLAYA DEL SOL

Rory’s last name is Lloyd.  I must disagree with your assessment of his character.  He was directly involved in selling my 83 year old widowed Mother a timeshare based on fraudulent inducements (he signed the purchase documents).  I suspect that the Gerry in your article is Jerry Forney – the Manager who refused to accept telephone calls from my Mother when she tried to cancel (I have his card).  This travesty occurred in March 2006 – she did not meet any of their qualifications and she has tried on at least three occasions to talk with representative to resolve the fact that she cannot afford the payments.  She has not received any response.  She is borrowing money from family to make the payments.  She was embarrassed to tell me what she had done so only recently did she admit to me what had occurred and I now have to deal with this.  Any assistance in addition to that contained on your web site would be greatly appreciated.  These people should be jailed – what they have done to my Mother is nothing short of elder abuse – if they will do this to one person they will do it to all.

I just got done with my training class last Friday as a Senior Area Manager (sales rep).  I live in Chicago and went on my first appointment today only to be thrown out after saying hi.  I cannot blame the guy because he lost over $30k with IPA and filed 2 lawsuits against us.  But for some reason that was considered a solid appointment by the telemarketing department.  After I got home and spoke to other reps who were running into the same thing I finally did some due diligence.  I have been online for over 13 hours pouring over all this information and stories that I am still speechless from.  From John Burgess the convicted ex con for grand larceny and being with a 16 year old prostitute, to how all these guys do is bleed companies with some capitol dry.  Needless to say I have decided to terminate my role with IPA.  However I saw your email address and that you are trying to bring them down and that you wanted to speak to employees and ex employees and that you needed the training material and manuals.  Well, I have all of it and would be happy to help you if you are in the process of going after IPA.  Please let me know if I can be of any help.

Subject: Austin Blake

I was surfing the web about Austin Blake.  This Realtor sold me and several other people in Maryland homes in Lehigh Acres and the lots were worth about $5,000 and sold them to us for $65,000 and up.  He gave us appraisals saying the property was worth approx. $330,000 and that he had several buyers lined up.  How can a property now be worth $200,000.  There were several of us scammed from this idiot.  But he was smart that is why we were scammed.  He verbally told us all these things and I tried to get out of the deal over a year ago before the house were started with Castle Builder, he told me at anytime he could sell them to another buyer because prices would continue to go up and when I tried to get out he said call the builder and the builder had no mercy.  I still do not have a copy of my appraisal.

I have a son going to college next year and I was trying to look for a good investment for a couple of years, I wrote the contract back in 2005, the houses are just now being complete and instead of making $30,000 on each house it is going to probably force me into foreclosure and I may even loose my house here in Maryland if Market Street Mortgage comes after me.  There is nothing I can do.  I don't have a bunch of money and I am not some big time investor. I sure hope he gets what is coming to him because it has been a living hell for me the last 8 months or more.

Add me to the list of people scammed and whatever I can do, let me know.

June 27, 2007

I have been receiving calls for over a month now from Allied interstate.  I had no idea who they were until I read all the complaints on this website.  I have no idea what they want.  No one has ever left me a message.  I have never rec'd anything in the mail stating that I owe a debt and they are trying to collect it.  Isn't it common practice to leave a message if you are calling about something important such as debt collection?

I never answered the phone when they came up on my caller ID until today (after I read the complaints) and when I said hello all I could hear was laughing and cussing and yelling in the background.  So I called the number from my cell phone.  A rude lady answered the phone with "Hello?"  I said," uh is this allied interstate?"  And she said," yeah why? " I said what kind of company are you?  She said "we are a financing company."  I said, "oh ok thank you." and she said, "who IS this?" I said "it doesn't matter, thank you for your time." and she screamed into the phone, "You better tell me who this is."  I hung up.

These people start calling me at 6am and don't stop until 10pm.  7 days a week including holidays.  They call me upwards of 10-20 times a day.  Yesterday, they called me 8 times in a row.  They would call, I wouldn't answer, they would get my machine, hang up and call me right back.

Can I report them for harassment to the FTC?  I am on the no call list.  These people are driving me insane.  After reading the web page today and having a small conversation with someone from Allied, I definatly do not want to deal with them at all.

To Whom It May Concern,

Hello.  My name is Renee Kirkpatrick.  About a month ago I was sent an e-mail from my credit monitoring agency telling me that my credit report had been pulled.  It showed that my credit report had been pulled by Chase Mortgage Companies.  After getting transferred from person to person on the phone I went with my husband to our local Chase branch.  While we were there we discovered that my ex-husband, who is now a Chase employee, had pulled my credit report.  He now has all of my information, my employer, social security number, credit cards, etc.  He also pulled the credit report of my husband.  In the past I had filled out police reports against him because he was an abusive person.  In the past he had threatened my life.  It has been 5 years and there had been absolutely no contact between us.  I finally felt safe.

Of course we shared all of this information with Chase.   To our knowledge Chase has not done a thing about this matter.  They told us that they are investigating this, but can't legally tell us anything.  They told us that they would provide us with information on how to protect our credit, but still have not.  We filled out reports with our local police agency, but they didn't take us very seriously.  We just have no idea what to do now.  What happened is illegal, but nobody seems to care.

I would appreciate any assistance you can provide.
Thank you for your time,
Renee Kirkpatrick

I have a question with our story.  We got ourselves into debt in 2001 and were completely unable to get out of it.  So, we did an incredibly stupid thing and ignored it.  In 2004 we went with debt free and attempted to pay but we owed too much and did not have enough left to live on so we quit.  Needless to say one of our debts ( a large one) was purchased by Unifund and we received a court summons.  The lawyers for Unifund were Bursey.  We did owe the money though the amount seemed high so we made payment arrangements, signed their agreement and have paid back about 2000.00.  I did not really want to drag my employer into this with a garnishment and am now in a better position to pay and want to pay so I thought...this is good. They stated we would not go to court as long as we followed the agreement.  We than received at court date.  I was paying and following the agreement so was not concerned about appearing in court but I thought it was weird so I called Bursey.  They stated they lost our paperwork and we would have to re-sign everything and all would be ok.  They sent us new paperwork, we signed again, I faxed them a copy and mailed the original usps.  We call and they received.  We still did not get a release from the courts so we called to see what was going on..They told my husband we had no proof the paperwork was sent.  I thought this was weird since Ted told me they had it and all was well so I called.  He told me he was putting me on speaker phone and proceeded to ask me questions.  I was taken aback since the second set of paperwork I sent included a copy of the first set and the original signatures of the second set and a cashiers check.. quite a lot of paperwork and I called and he said they had it.  He than told me they lost it again and since I work in an office, I would understand.  I do and I don't understand.  He wanted to fax me a new set of papers for me to expedite back to them.  I said no because  our fax is being repaired and we have a loaner at work.  At this point I did not see the point, I sent the first set DHL and they received them, I sent the second set certified and they received them; therefore, I had no confidence that the third set would not meet the same fate.  They also told my husband that they do not send receipts, the copy of our cashiers check is our receipt.  Therefore, we are driving from Phoenix to Tucson to sign our papers and get a receipt. Finally to the question:
Are they trying to trick us up and get our house or something
Maybe they would rather garnish then accept our cashiers checks
since they know the law is there something I should be wary about
I find it very very hard to believe that they could be loosing this paperwork but its their paperwork and I figured said paperwork would be to their advantage not ours.
I am happy with our payment arrangement and am committed to seeing it through, do you think they are not? Please advise    dmayn93493@aol.com

Allied Interstate called the university that my child attends and told the department secretary that they need to speak with my daughter in an attempt to collect a dept. IS this not against the privacy act?

We received your article from someone in CA. who is in the same bind we are in, as well as several
others that we know of (so far).
We invested in 4 properties with Austin Blake in Florida and now are facing 4 foreclosures.  The one
bank which was him preferred lender told us they will be going after our assets.  I am so sick, can't sleep
nights.  My husband is on disability and I am the one who supports our family.  If feel like I am going
around in circles, not getting anywhere with attorneys, banks, etc.  Desperately need help.
The only people that made any money from this venture is Austin Blake and all the people that he is invloved with.  So far, it has cost us thousands.
Please E-mail or call me and maybe you can help us, maybe direct us.
My E-mail is DSushi55@aol.com and my home number is (631)737-4494 and my cell is (631)428-0385.
Thank you,
Patiently and hopefully waiting to speak with you.

Mr. Paisola:

I was trying to find an address online for Allied Interstate today and ran
across your website.

I am currently receiving numerous calls for my son, Matthew, from Allied
Interstate.  I have told them over and over again that he does not and has
not lived with me since he was 18 years old (he is now 21), and I have
been telling them this for at least a year.  I have also told them that my
son and I do not get along very well and that most of the time he does not
speak to me so they are wasting their time by calling my phone number.  I
have requested numerous times that they remove my telephone number from
their system, and have even given them his phone number, but I still
continue to receive phone calls from them.

They call at least one time per day and leave messages on my answering
machine, and most days they call back in the evening to try to get in
touch with Matthew.  If you answer the phone when they call, you get a
recording asking you to hold (or requesting that you call them back) and
the recording tells you that your call is very important to them.  The
last time I called and told them that they have the wrong phone number I
was on hold for 20 minutes before hanging up and calling back, and then
was on hold for another 25 minutes before I actually was able to speak to
a very rude young man.

Allied Interstate is driving me crazy with their phone calls, and their
outright refusal to remove my phone number from their system is nothing
more than harassment and an invasion of my privacy.  I pay for my
telephone service for my convenience, not theirs.

I am trying to find an address for them so I can send them a certified
letter requesting, pursuant to the Texas Fair Debt Collection Practices
Act, that they remove my telephone number from their system.  So far, I
have not been able to find an address for them.  I will probably seek the
services of an attorney in the near future to stop these harassing calls,
unless you have a suggestion in the meantime.

Thank you.  Betty Rutherford

June 13, 2007

I was contacted by Allied Interstate on February 12,
2007, the man on the phone said that I was delinquent
with my payment to American Express, I owed $1285.52,
this was true.  I told him that I would have to call
him back when I got home from the trip that I was on.
On February 12, 2007 I was told that the billing cycle
for this card was the second of every month and to
avoid late fees I would have to pay prior to March 2,
2007.  Interest was accruing.  On February 24 I had a
conversation with Miss Sheila Jackson at Allied
Interstate, I told her that I was uncomfortable giving
her my checking account information and that I would
rather mail payment to American Express, after an hour
of being verbally abused by Miss Jackson I gave her my
routing and checking account information.  The payment
was made in the amount of 1320.52.  I asked Miss
Jackson if the account was closed and if this payment
would take care of any and all interest, her response
was that the account was closed and this amount was a
payoff amount.  You will notice that the amount was
65.00 more than it was ten days prior!  In April, May,
and June I received a statement saying that I owed
additional funds to American Express.  I called
American Express and they directed me to Allied
Interstate at 1-800-834-1429.  I called the number and
talked to a human being that would transfer me to
various voicemail boxes.  Messages were left and none
were returned!  On June 11, 2007, I decided to push
harder and talked to a Joseph Westerfield at extension
2385.  When the call was placed a man answered and
transferred me to Joseph.  Joseph told me that the
interest is billed at the end of the month and that
you have to make two payments to take care of the
debt.  I further questioned him about supplying him
with my checking account information, his response was
to mail the payment to American Express, when
questioned about why this could not have been done in
February he changed his mind about paying American
Express, I questioned him why he changed his mind and
why he was pressuring me to give him my checking
account information, he said that he had never implied
that I pay American Express.  I asked again about what
he exactly said his reply was that the conversation
was being recorded.  I then asked Joseph why I had
never been told that the conversation was being
recorded; his response was that the recording at the
beginning of the phone call says that it might be
recorded.  I informed Joseph that there was no
recording, I had reached a human and was transferred
directly to him.  I expressed even greater concern
over the illegal recording of the phone conversation
as well as the amount of money that was owed since the
debt had been paid off to Miss Jackson on February 24,
2007.  Joseph became irate and wanted the checking
account information, I am now sending American Express
100.00 dollars directly and probably will continue to
do so or the next few months.  This company continues
to call my corporate cellular phone at all hours, are
there no rules?

CAUTION--

This information was pulled directly from another blog. We just had a conversation with Mr. Brandon Callier and he said that he was ABSOLUTELY not E. Normis Debtor or Uncle Normie. He said that there is a possibility that his partner, Craig Cunningham is the correct person. At the end of the call, he assured us that he would call back with Craig Cunningham on the phone.

E. Normis Debtor finally exposed-

E. Normis Debtor has finally been exposed. What exposed him was a new blog he started.

The revealing factors are:

1. The background style of the blog. Typical Normie. He never uses any imagination or diversity in choosing backgrounds for his blogs. They are all copies of each other.

2. He uses links to one of his other blogs blatantly proclaiming it to be his own.

3. He links to debtorboards.com which is a favorite of his.

4. He links to Christine Baker's web page.

5. He links to the old pcmholdings forum which he ruined with his rantings and caused it's demise a few months ago.

6. He talks about another board known as creditnet

as well and checking that web page tells all that CCH CONSULTING is located at 6336 Franklin Trail in El Paso, Texas.

We checked the property records in El Paso County Texas and found that the property mentioned belongs to Brandon L. and Anna Callier.

So the whole sordid story of why Brandon L. Callier AKA E. Normis Debtor AKA Uncle Normie chases all over the internet badmouthing others now becomes plain for all to see.

He percieves them to be competitors and stealing his business. Badmouthing one's competitors has never been a wise thing to do. It always hurts your own business more than it hurts the intended victim.

I received a call today and I was incredibly frustrated with the woman on the other end of the line. She insisted that I had to pay over $200 dollars in fees and she could do nothing about it. I got it wiped out by making a few other phone calls.

May 14, 2007

I am freaking out about this now. My boyfriend Jason and I moved back to Michigan form Florida. We are staying with my mom. One day a woman named Sue called looking for my boyfriend. She said that she needed him to call as soon as possible and I told her that he worked 2nd shift, 3:00 – 11:00 so they would have to contact him before 2:00. They started calling at night, and they would call in the morning. They called 5 times in one day. I finally got really angry and asked the lady if she could tell me anything even though I wasn’t the one that had the debt. She said that it was for a balance due from a credit card in 2003. Now why in the world did it take 4 years for that to catch up with him? He has been paying on it for 2 months now and he is sending 100.00 dollars a week. Saturday morning we got his money order back from the previous week. The letter said that they were unable to locate his account. We called and it was a 1-800 number for a place in India, they were closed. So this Monday morning he called and talked to a man named Frank. Jason told Frank that he had gotten his money order back and that he wanted to know why. Frank asked him if the money was for the CD’s or the Books??!!  J was shocked he had no clue what this man was talking about, Frank told him that he couldn’t help him and that he was sorry. J hung up and called back again and gave him the same information. Frank said that he found his account and that his last payment had been recorded on May 10th. Which is impossible because the money order that would have paid for that time period was in his hand. So I don’t know if he should keep sending money or what. These people make me really nervous!

Thanks for letting me tell my story,

Samantha Hamilton <shamilton@jmarksystems.com>

With my previous e-mail I forgot to include the number that J has been advised to call. The number is 1-866-383-5074, and looking through the past complaints I haven’t seen that number listed.

To whom it may concern:

I bought 2 homes from a builder in which Austin Blake was the Realtor involved.  He seemed to mislead me in the end, however, I am not sure that he did anything illegal!?

I have all correspondence from him and a copy of all contracts and emails exchanged.  If you can let me know what to look for, I can go back and see if he did anything unlawful.  Right now, it is my gut feeling that I made a bad investment, however, I wouldn't be surprised if I was manipulated in some way.

If you can let me know what to look for, I can review all of my paperwork and emails.

Hello, we have purchased two properties through him, and are currently suffering the consequences.  I am currently pursuing information with the appraiser that he worked with to inflate the lot and property appraisals.  The lot values were easily double of what they should have been, and now everyone that is involved with him owns a home that is 40-50k below market value.  I think all parties involved with the funding of these loans:  Austin Blake, the appraiser, and Market Street Mortgage need to be investigated to determine the responsible party for the over inflation and fraud that gave created value to these properties.

Thanks,

Jamie jamie.smith@true-investor.com

Candida Haynes 7 10 10 7  NO  I'm still not sure that I am looking to establish an agency. What I want to offer are mediation services. I won't be "reporting" the clients to potential vendors or seeking to establish liens on their finances. My role would really be to clarify the procedures for clients and vendors in new working relationships. For the record, I think the rating is misleading. You may have known more about my issue, but perhaps my question was unclear. I tried to consider that in my rating. You very clearly answered the question you thought I was asking, but I needed a little more information to be sure that you were answering what I really need to know. For example, am I really talking about collections? That being said, I do genuinely appreciate your taking the time to answer my questions for free! I think this is a useful service and will probably prove profitable as users' business needs become more complicated. In the mean time, I am going to do a little more of my own research. The web site link you provided did help me to identify how I might clarify my question. Thanks again!

What do you like about this subject?   One thing that I have learned in this business is that I believe that all people are essentially good and that EVERYONE has or has had difficult times in their lives. My experience as a portfolio manager and call center manager to being a CEO has taught me that 99% of consumers do not realize their rights when dealing with collection agencies.
What do you still hope to achieve/learn in this field?   I am always being asked by members of the media to comment on cases relating to debtor/creditor issues. I welcome these questions and am avaliable for members of the media (see www.expertclick.com/19-2637 ) . I am able to see both sides and am always looking for the "middle ground" so that everybody wins. I train debt collectors around the world.
Something interesting about this subject that others may not know:   UPDATE- 7-2006 LISTEN TO A LIVE 3 STAGE CALL to ALLIED INTERSTATE AND INTELLIRISK- AS THEY VIOLATE FEDERAL LAW....WITH ROBERT PAISOLA! Robert Paisola wins $30,000 in FDCPA Damages in 45 Minutes! GO TO www.MyWesternCapital.com/news_allied.html NOW! This is a LIVE AUDIO FEED THAT WILL GIVE YOU AN IDEA HOW YOU HAVE TO DEAL WITH COLLECTORS WHO CROSS THE LINE. IF YOU HAVE HAD PROBLEMS LET US KNOW!
Something controversial or provocative about this subject   The days of the BIG BAD BILL COLLECTOR are over! The companies who operate like this are at serious risk. My moto is "People pay their friends...not their enemies!" I wrote a book on that subject entitled "The Art of Getting Paid" and it was a best seller! Check it out at www.mycollector.com/store.html
